1. Scope and Contract Formation
1.1 Sharkfin Entertainment KG (hereinafter "Operator") provides its services exclusively on the basis of the following Terms and Conditions (T&C). These apply to all legal relationships between the Operator and the Customer.
1.2 Any terms and conditions of the Customer will not be accepted, even if known, unless expressly agreed otherwise in individual cases. The Customer's terms and conditions are expressly rejected.
1.3 If individual provisions of these T&C are or become invalid, the validity of the remaining provisions remains unaffected. Invalid provisions are replaced by statutory regulations.
1.4 Offers from the Operator are non-binding and subject to confirmation.
2. Scope of Services, Safety and Cooperation Obligations
2.1 The scope of services is determined by the respective service description or booking confirmation.
2.2 Liability
The Operator is only liable for damages in cases of intent or gross negligence.
In cases of slight negligence, the Operator is liable only for breaches of essential contractual obligations whose fulfilment makes the proper execution of the game possible in the first place and on whose compliance the Customer may regularly rely. In such cases, liability is limited to typically foreseeable damages.
Liability for damages from injury to life, body or health remains unaffected.
2.3 Children under 14 may only participate when accompanied by an adult guardian. The guardian is responsible for supervising the children.
2.4 House rules
Anyone who harasses other visitors, disregards safety instructions or significantly disrupts the game can be excluded from the game. No right to a refund exists in such cases if the exclusion was caused by the Customer.
2.5 Persons under the influence of alcohol or other psychoactive substances as well as persons with serious health restrictions (e.g. heart disease, epilepsy) are excluded from participation.
2.6 Smoking, open flames and carrying dangerous objects (e.g. weapons) are prohibited.
2.7 The Customer is liable for damages caused intentionally or through gross negligence.
2.8 Theft
Any theft or attempted theft will be reported. Additionally, actually incurred expenses (particularly organisational expenses), but no more than EUR 250, may be charged.
3. Appointments, Lateness, Cancellation and Rescheduling
3.1 Punctuality
Customers are asked to arrive approximately 10 minutes before the booked time.
In case of late arrival, the game can only be conducted within the remaining playing time to avoid delaying subsequent appointments.
If lateness exceeds 30 minutes from the planned game start or if regular gameplay is no longer possible due to remaining time, the Operator may refuse to conduct the game.
In such cases, the Operator is entitled to demand reasonable compensation up to the amount of the booking total, as the appointment generally cannot be rebooked at short notice.
The Customer retains the right to prove that no or substantially lower damage occurred.
3.2 Cancellation / No-Show
Cancellation is free of charge up to 24 hours before the appointment.
For later cancellations or no-shows, the Operator is entitled to demand reasonable compensation for the loss incurred (particularly staff, preparation and capacity costs), but no more than the booking total.
The Customer retains the right to prove that no or substantially lower damage occurred. The Operator retains the right to prove higher damage.
3.3 Rescheduling
Rescheduling is free of charge up to 24 hours before the appointment. After that, reasonable compensation may be demanded. The Customer retains the right to prove that no or substantially lower damage occurred.
3.4 All compensation is subject to judicial moderation.
4. Fee
4.1 The fee becomes due upon binding booking.
4.2 Prices include statutory value-added tax as per price list.
4.3 Surcharge outside time slots
A surcharge of EUR 36 incl. VAT applies for bookings outside the time slots offered on the online platform. For individually agreed special appointments, the specific surcharge is expressly communicated to the Customer before binding booking.
5. Payment, Retention of Title
5.1 Invoices are payable immediately without deduction.
5.2 In case of payment default, statutory default interest applies. Dunning and collection expenses may be charged insofar as they are necessary for appropriate legal pursuit.
5.3 The Operator may withhold services until full payment.
5.4 In case of agreed instalment payments, payment default may result in loss of due dates.
5.5 Set-off
A set-off is only permissible if the Operator is insolvent, the counterclaim is in legal connection with the same contractual relationship, or it has been recognised or established by a court.
6. Property and Copyright
6.1 Game content remains the property of the Operator. Photo, audio and video recordings are prohibited.
6.2 Any use beyond the agreed purpose requires the consent of the Operator.
6.3 Unauthorised use may be charged at up to twice the reasonable remuneration.
7. Data Protection / Video Surveillance
The game areas are video-monitored for security reasons. Processing takes place on the basis of legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR for the protection of persons and property. Video surveillance is marked accordingly; evaluation generally only takes place on a case-by-case basis.
Recordings are generally deleted after a maximum of 72 hours, unless required for clarifying specific incidents.

8. Applicable Law
Austrian law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
9. Final Provisions
9.1 Place of performance is the registered office of the Operator.
9.2 Personal designations apply equally to all genders.
9.3 Changes or additions to these T&C require text form (e.g. email).

2. Scope of Services, Safety and Liability
2.1 The scope of services is determined by the respective game description.
2.2 Personal Responsibility and Safety
Participation is at one's own responsibility. Customers must comply with traffic rules and pay attention to surroundings, weather and public dangers.
2.3 Liability
The Operator is only liable for damages in cases of intent or gross negligence.
In case of slight negligence, the Operator is only liable for breaches of essential contractual obligations; liability is limited to typically foreseeable damages.
Liability for personal injury remains unaffected.
2.4 Tablets
Tablets must be handled with care. In case of damage or loss, the Customer is liable for actually incurred repair or replacement costs up to the device value.
2.5 Participation Conditions
Children under 14 only with supervising adult. Influence of alcohol or drugs leads to exclusion.
2.6 House Rules
In case of dangerous or disruptive behaviour, exclusion may occur. No right to a refund exists if exclusion was caused by the Customer.

Bookings are binding. Customers must arrive punctually at the agreed meeting point.
Delays of more than 15 minutes may lead to exclusion from the game if regular gameplay is no longer possible. In such cases, the Operator is entitled to demand reasonable compensation up to the amount of the booking total.
3.2 Cancellation / No-Show
Cancellation is free of charge up to 24 hours before the booked appointment.
For later cancellations or no-shows, the Operator is entitled to demand reasonable compensation for the loss incurred, but no more than the booking total.

Rescheduling is free of charge up to 24 hours before the appointment. After that, reasonable compensation may be demanded.
4. Payment
Invoices are due immediately. Statutory default interest applies.
5. Data Protection
